Terms and Conditions

TutorGator provides live one-to-one online tutoring sessions for students in Primary (Years 2 to 6), High School (Years 7 to 10), and Senior (Years 11 to 12) year levels, across a range of subjects including English, Mathematics, Science, NAPLAN preparation, Selective and OC exam preparation, Writing, and Thinking Skills. Sessions are delivered through our own browser-based Platform, which includes a real-time collaborative whiteboard, live video, session chat, and resource sharing. No software installation is required.

We aim to make the Platform available during all scheduled sessions. In the event of a platform outage preventing a scheduled session, we will reschedule at no additional cost. We do not guarantee uninterrupted, error-free access at all times. Scheduled maintenance will be carried out outside session hours wherever possible.

TutorGator may update Platform features from time to time. We will give reasonable notice of any changes that materially affect your enrolled program. Pricing changes will be communicated before the next enrolment period and will not affect fees already paid for a current term.

Enrolments must be completed by a parent or legal guardian aged 18 or over. Minors may not create accounts or complete enrolments on their own behalf.

Student platform accounts are created by TutorGator administrators only. Students cannot self-register. This is a deliberate safety measure to protect the privacy and security of minors. Once enrolled, the student will receive login credentials to access their session environment.

You agree to provide accurate, current, and complete information when enrolling. TutorGator is not responsible for any consequences arising from incorrect information, including incorrect year level or subject selection.

TutorGator charges a single flat rate of AU$75.90 per hour (incl. GST) per subject. Each term consists of 10 × 60-minute sessions, giving a total of AU$759 per subject per term. All prices are in Australian dollars inclusive of GST.

Each enrolment covers one subject for one term. Multiple subjects require separate enrolments and payments. Full payment is due at the time of enrolment before sessions commence.

Your enrolment is confirmed upon receipt of full payment. You will receive a confirmation email containing your session schedule, start date, and platform access instructions within 24 hours of payment. If you do not receive a confirmation, contact admin@tutorgator.com.au.

Mid-term enrolments are available at a pro-rated fee calculated at AU$75.90 per 60-minute session for the remaining sessions in the term. Mid-term enrolments must be arranged directly with TutorGator. Contact admin@tutorgator.com.au or 1300 042 867.

TutorGator will allocate a qualified WWCC-verified tutor based on the subject, year level, and availability. We reserve the right to reassign a tutor where necessary due to illness, resignation, or operational reasons. We will give as much notice as possible in the event of a tutor change.

Payments are processed securely through our payment provider. TutorGator does not store payment card details on its own systems. Afterpay is available as an alternative payment method, allowing payment in 4 equal instalments of AU$189.75 per subject per term interest-free.

If a payment fails at enrolment, the enrolment will not be confirmed and no sessions will be scheduled until payment is received. Contact admin@tutorgator.com.au if you experience payment difficulties.

TutorGator reserves the right to adjust fees for future enrolment periods. Any changes will be communicated before the next enrolment period and will not affect fees already paid for a current term.

If you cancel before your child's first session takes place, you are entitled to a full refund of all fees paid. No cancellation fee applies.

Within 7 days of your child's first session, you may request a full refund of fees paid for unused sessions (calculated at AU$75.90 per unused session). To request, email admin@tutorgator.com.au within 7 days of the first session.

• More than 5 sessions remaining: refund for unused sessions less an administration fee of AU$150
• 5 or fewer sessions remaining: no refund for unused sessions
• Refunds processed within 10 business days of written confirmation

• More than 48 hours' notice: session rescheduled at no charge
• Less than 48 hours' notice: cancellation fee of AU$37.95 (50% of per-session rate) applies. Session forfeited.
• No-show (no notice): full per-session rate of AU$75.90 charged. Session forfeited.

All cancellations must be submitted in writing to admin@tutorgator.com.au or via WhatsApp.

You may pause your enrolment mid-term at any time. Contact admin@tutorgator.com.au to arrange a pause. Unused sessions at the time of the pause will be held and available when you resume. Pauses are subject to tutor availability on resumption.

If TutorGator cancels or reschedules a session, the affected session will be rescheduled at no charge. If TutorGator discontinues a program before the end of a paid term, affected parents will be notified promptly and will receive a full pro-rated refund for unused sessions.

Our services come with consumer guarantees under the Australian Consumer Law that cannot be excluded. Nothing in these Terms limits those guarantees.

Each session is 60 minutes in duration, delivered live and one-to-one through the TutorGator Platform. Sessions include collaborative whiteboard work, live video, and session chat. The tutor will provide written session notes and a progress update to the parent after each session.

• Google Chrome, Microsoft Edge, or Safari (latest version)
• Working webcam and microphone
• Laptop, desktop, or tablet capable of running a modern browser

TutorGator is not responsible for disruptions caused by technical issues on the student's side. Such sessions will be treated as a late cancellation under Section 6.4.

Sessions delivered through the Platform may be recorded for quality, review, and educational purposes. By enrolling, you consent to sessions being recorded. Recordings are accessible to the student, parent, and TutorGator administrators.

The Platform is provided for personal, non-commercial educational use by enrolled students and their parents, and for session delivery by authorised tutors. Any other use is prohibited.

You must not, and must ensure the student does not:

• share account login credentials with any third party
• attempt to access any part of the Platform without authorisation
• reverse-engineer, copy, or decompile the Platform
• upload or transmit any unlawful, offensive, or harmful content
• use automated scripts, bots, or tools to interact with the Platform
• impersonate any person, including a tutor or TutorGator staff member

Students are expected to engage respectfully with their tutor. TutorGator reserves the right to suspend or terminate a student's access without refund if their conduct is abusive, disruptive, or inappropriate.

All tutors are required to hold a valid and current WWCC before delivering any sessions. TutorGator verifies WWCC compliance during onboarding and monitors expiry dates. Any tutor whose WWCC is revoked will have their platform access immediately suspended.

Student accounts are created solely by TutorGator administrators. No member of the public can independently access the student-facing environment.

If a parent has any concern about a tutor's conduct or any interaction through the Platform, contact TutorGator immediately at admin@tutorgator.com.au or 1300 042 867. TutorGator takes all such concerns seriously and will investigate promptly, referring matters to relevant authorities where required.

Our services come with consumer guarantees under Australian Consumer Law. To the extent permitted by law, TutorGator's liability for breach of a non-excludable guarantee is limited to resupply of the service or the cost of resupply.

TutorGator's total liability for any claim will not exceed the total fees you have paid to TutorGator in the 12 months preceding the claim.

To the maximum extent permitted by law, TutorGator is not liable for any indirect, incidental, or consequential loss, including loss of data, loss of academic results, or loss of opportunity.

TutorGator does not guarantee specific academic outcomes, grade improvements, or exam results. Tutoring outcomes depend on many factors outside TutorGator's control, including the student's effort, engagement, and attendance.

Parents may cancel an enrolment at any time in writing. Cancellation terms and refund entitlements are set out in Section 6.

TutorGator may immediately suspend or terminate a student's access, without refund, if: the student or parent engages in abusive or threatening conduct; these Terms are materially breached; payment has not been received; or the student's use of the Platform poses a safety risk.

These Terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales for any dispute that cannot be resolved informally.
